1. general provisions
1.1. These Terms and Conditions govern the use of the online store available at www.kalarthe.com.
1.2. The online store is operated by Kalina Grdeń, conducting business under the name Decor Form Kalina Grdeń, with its registered business address and correspondence address at: ul. Żeromskiego 10a, 58-100 Świdnica, Poland, NIP: 8851587630, REGON: 527117843, e-mail: hello@kalarthe.com, phone number: +48 506993085.
1.3. KALARTHE is a brand and commercial project created and operated by Decor Form Kalina Grdeń. All sales agreements concluded through the store, as well as all settlements, invoices, payments, complaints, returns, and claims, are handled by Decor Form Kalina Grdeń.
1.4. These Terms and Conditions are addressed to both consumers and business customers, unless a specific provision states otherwise.
1.5. The administrator of personal data processed in connection with the use of the store is Decor Form Kalina Grdeń. Detailed rules regarding the processing of personal data are set out in the Privacy Policy available in the store.
1.6. Customers are required to use the store in accordance with the law, good practice, and these Terms and Conditions.
2. definitions
For the purposes of these Terms and Conditions, the following definitions apply:
Business Day – any day from Monday to Friday, excluding public holidays in Poland.
Customer – any natural person, legal person, or organizational unit with legal capacity that places or intends to place an order in the store.
Consumer – a natural person acting for purposes outside their trade, business, craft, or profession.
Store – the online store operated under the domain kalarthe.com.
Seller – Decor Form Kalina Grdeń, as identified in section 1.2 above.
Brand – KALARTHE, being a brand/project operated by the Seller.
Product – any movable item offered for sale in the store.
Order – a declaration of intent submitted by the Customer through the store, aimed directly at concluding a sales contract with the Seller.
Sales Contract – a distance contract for the sale of a Product concluded between the Customer and the Seller through the store.
Electronic Service – a service provided electronically by the Seller through the store, including in particular the customer account, order form, and newsletter, if enabled.
3. electronic services
3.1. The store may provide the following electronic services:
- customer account,
- order form,
- newsletter,
- any additional store features made available by the Seller.
3.2. The use of the order form is free of charge and is a one-time service that ends once the order is placed or the ordering process is abandoned.
3.3. If the customer account feature is enabled, creating and maintaining an account is free of charge for an indefinite period. The customer may delete the account at any time by contacting the Seller at hello@kalarthe.com.
3.4. If the newsletter feature is enabled, subscribing to the newsletter is voluntary and free of charge. The customer may unsubscribe at any time using the unsubscribe link in the message or by contacting the Seller.
3.5. Technical requirements necessary to use the store include:
- an internet-enabled device,
- an up-to-date web browser,
- an active e-mail address,
- cookies and JavaScript enabled where necessary for the store’s proper functioning.
3.6. Complaints regarding electronic services may be submitted by e-mail to hello@kalarthe.com. The complaint should include, where possible, the customer’s details, a description of the issue, and the requested resolution. The Seller will respond without undue delay, no later than within 14 days.
4. products and product information
4.1. Products offered in the store are handmade, made-to-order, or small-batch physical goods, unless expressly stated otherwise in a product description.
4.2. The Seller makes reasonable efforts to ensure that product descriptions, photographs, colors, dimensions, and other information displayed in the store are accurate. However, due to the handmade nature of products, individual pieces may differ slightly from the photographs or descriptions, in particular in texture, weave, shade, or minor finishing details.
4.3. Where a product is made to order, customized, or adjusted to the customer’s specifications, the product description should indicate this.
4.4. The customer is responsible for reviewing the product description, dimensions, options, and care instructions before placing an order.
5. conclusion of the sales contract
5.1. A Sales Contract is concluded when the customer places an order through the store and receives confirmation from the Seller that the order has been accepted for processing.
5.2. Before placing the order, the customer is informed about:
- the main characteristics of the product,
- the total price,
- any delivery costs,
- available payment methods,
- the right of withdrawal where applicable.
Consumers must be clearly informed about the seller’s identity, pricing, key contract terms, and their rights before placing an order.
5.3. After the order is placed, the Seller sends an order confirmation to the e-mail address provided by the customer.
5.4. The contract is concluded in the English language, unless the Seller explicitly provides another language version.
6. prices and payments
6.1. Product prices shown in the store are given in the currency displayed in the store and include taxes where applicable under the law.
6.2. The customer is informed of the total order price, including taxes and delivery charges, before finalizing the order. Consumers must be told the final price and other costs before being bound by the contract.
6.3. The Seller may offer the following payment methods:
- payment card,
- PayPal,
- Stripe / Shopify Payments,
- bank transfer, if enabled,
- any other payment methods shown at checkout.
6.4. Payment processing is carried out by the external payment service providers selected by the customer during checkout.
6.5. Unless otherwise stated, payment must be made immediately when placing the order.
6.6. If payment is not completed, the Seller may cancel the order.
7. shipping, delivery, and order processing
7.1. Products are delivered to the address indicated by the customer during checkout.
7.2. Delivery methods and shipping costs are displayed in the store and during checkout.
7.3. Estimated processing and delivery times are indicated in the product description, shipping policy, or at checkout.
7.4. Unless a shorter period is expressly stated, the estimated dispatch time is:
- 3-5 business days
- up to 21 business days
7.5. Delivery times are estimates and may vary depending on destination, courier delays, customs processing, or peak periods.
7.6. If products with different dispatch times are ordered together, the longest stated dispatch time may apply to the whole order, unless the Seller decides otherwise.
7.7. For international orders, the customer is responsible for any customs duties, import taxes, or local charges imposed by the destination country, unless otherwise stated by the Seller.
8. consumer complaints and non-conformity of goods
8.1. If a product sold to a consumer is not in conformity with the contract, the consumer has rights provided by the Polish Act on Consumer Rights.
8.2. As a rule, the Seller is liable to the consumer for lack of conformity of the goods with the contract for 2 years from delivery. Complaints for consumer purchases are based on non-conformity of goods with the contract, and the consumer may seek repair, replacement, price reduction, or withdrawal from the contract under the statutory rules.
8.3. A complaint may be submitted by e-mail to hello@kalarthe.com or in writing to:

8.4. The complaint should, where possible, include:
- the customer’s name,
- order number,
- description of the issue,
- date the defect/problem was noticed,
- requested remedy.
8.5. The Seller will respond to the complaint within 14 days of receiving it.
8.6. If necessary to assess the complaint, the Seller may ask the customer to provide photographs, additional information, or return the product.
8.7. This section does not exclude any mandatory consumer rights granted under applicable law.
9. withdrawal from the contract
9.1. A consumer who concludes a distance contract may withdraw from it within 14 days without giving any reason. For online sales, the withdrawal period is generally 14 days.
9.2. The withdrawal period expires after 14 days from the day on which the consumer, or a third party other than the carrier and indicated by the consumer, takes physical possession of the goods.
9.3. To exercise the right of withdrawal, the consumer must send a clear statement of withdrawal to:

9.4. The consumer may use the model withdrawal form included at the end of these Terms and Conditions, but it is not mandatory.
9.5. The consumer must send back the product without undue delay and no later than 14 days from the day on which the withdrawal was communicated. The Seller may withhold reimbursement until the returned goods are received or the consumer provides proof of return shipment, whichever occurs first.
9.6. The consumer bears the direct cost of returning the goods, unless the Seller agrees otherwise.
9.7. The Seller will reimburse all payments received from the consumer, including the cost of the least expensive standard delivery method offered by the Seller, without undue delay and no later than 14 days from receiving the withdrawal notice, subject to section 9.5.
9.8. The consumer is liable for any diminished value of the goods resulting from handling the goods in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
10. exceptions to the right of withdrawal
10.1. The right of withdrawal does not apply in the cases provided by law.
10.2. In particular, the right of withdrawal may not apply to contracts for the supply of goods that are:
- non-prefabricated,
- made to the consumer’s specifications,
- clearly personalized.
The statutory withdrawal right may be excluded, among other cases, for non-prefabricated goods made to the consumer’s specification or clearly personalized goods.
10.3. If a Product is made to order, customized, or adjusted to the customer’s individual requirements, the Seller may indicate in the product description that the right of withdrawal does not apply to that specific Product to the extent permitted by law.
11. out-of-court dispute resolution
11.1. Consumers may use out-of-court complaint and redress methods available under Polish law.
11.2. Information on consumer rights and available complaint mechanisms can be found on official UOKiK resources. The former EU ODR platform has been discontinued, and the submission of complaints through it was discontinued on 20 March 2025.
12. provisions for business customers
12.1. The provisions of this section apply only to customers who are not consumers, except where mandatory law provides otherwise.
12.2. To the fullest extent permitted by law, the Seller’s liability towards a business customer is excluded or limited to the amount actually paid by that customer for the relevant order.
12.3. The Seller may set different payment terms, require prepayment, or refuse certain payment methods for business customers.
12.4. Any disputes with business customers shall be subject to the jurisdiction of the court competent for the Seller’s registered business address, unless mandatory law provides otherwise.
13. intellectual property
13.1. All content available in the store, including photographs, texts, graphics, branding elements, product descriptions, and the KALARTHE name and visual identity, is protected by applicable intellectual property laws.
13.2. Unless otherwise permitted by law, no content from the store may be copied, reproduced, distributed, or used for commercial purposes without the Seller’s prior written consent.
14. personal data and privacy
14.1. Personal data is processed for the purposes of operating the store, processing orders, handling complaints and returns, and fulfilling legal obligations.
14.2. Detailed information on personal data processing, cookies, and customer rights is available in the Privacy Policy.
15. final provisions
15.1. These Terms and Conditions are governed by Polish law, subject to mandatory consumer protection provisions that may apply in the consumer’s country of habitual residence.
15.2. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
15.3. The Seller may amend these Terms and Conditions for important reasons, including:
- changes in law,
- changes in payment methods,
- changes in delivery methods,
- changes in the scope or functionality of the store.
15.4. Changes to the Terms and Conditions do not affect orders placed before the changes take effect.
15.5. The current version of these Terms and Conditions is made available in the store.
